CITY OF COLTON <br />CITY COUNCIL/SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY <br />FOR THE CITY OF COLTON/COLTON UTILITY AUTHORITY/ <br />COLTON PUBLIC FINANCING AUTHORITY AND <br />COLTON HOUSING AUTHORITY <br />CLOSED SESSION MINUTES <br />September 1, 2015 <br />Closed Session Meeting was held on the above given date at 5:00 p.m., in the Council Chambers of City Hall, <br />with Mayor DeLaRosa presiding. <br />CITY COUNCIL ROLL CALL <br />Councilmembers present were, Toro, Jorrin (appeared at 5:10 p.m), Gonzdlez, Bennett (appeared at 5:45 p.m), <br />Suchil, MPT Navarro, and Mayor DeLaRosa. <br />STAFFPRESENT <br />City Manager Smith, Asst. City Attorney Martinez, and City Clerk Padilla. <br />PUBLIC COMMENT <br />None. <br />Asst. City Attorney Martinez announced that the City Council would meet in Closed Session to Discuss Items A <br />through C. <br />CLOSED SESSION <br />A. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION <br />Significant Exposure to Litigation, Pursuant to Government Code Section 54956.9(d)(2) <br />One (1) potential case <br />B. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION <br />Initiation of Litigation, Pursuant to Government Code Section 54956.9(d)(4) <br />One (1) potential case <br />C. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION <br />Pursuant to Government Code Section 54956.9(d)(1) <br />Largo Concrete, Inc., v. City of Colton, el al. <br />San Bernardino Superior Court, Case No. CIVDS 1400406 <br />Mayor DeLaRosa adjourned the meeting to Closed Session at 5:01 p.m. and at 6:05 p.m., the meeting <br />reconvened, with all members present as heretofore. <br />Assistant City Attorney Martinez announced that the City Council met in Closed Session and discussed Items A <br />through C. Item A: Direction given to staff with no reportable action.; Councilmember Bennett was not present <br />at the discussion of this item. Item B and C: The City Council by a vote of 5 to 2, with Mayor DeLaRosa and <br />Councilmember Jorrin voting in the negative, authorized the City Attorney to pursue an immediate appeal <br />and/or stay of the Largo writ order and a subsequent appeal.
