CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of July 18. 1989 <br />TO: Honorable Mayor and City Council <br />FROM: Leslie A. Keane, City Manag <br />4 SUBJECT: Approval of Regional Tertiary Treatment Project Date: July 14, 1989 <br />Agreements <br />In -May of the current year, the Council approved two agreements for the operation <br />of a.regional wastewater treatment demonstration project. These agreements <br />anticipated that the San Bernardino Valley Municipal Water District (SBVMWD) would <br />negotiate site options and purchases and would obtain the required construction <br />and discharge permits. In the process of finalizing the agreements, we have been <br />unable to negotiate a number of liability issues with SBVMWD and they have decided <br />not to participate in the project. The Santa Ana Watershed Project Authority <br />(SAWPA) has, however, agreed to obtain the required permits and act as oversight <br />agency for the demonstration project. The City of San Bernardino has also offered <br />to operate the demonstration project through the initial testing stages. <br />Neither the City of San Bernardino nor Colton has committed to the permanent <br />operation of a regional tertiary facility in lieu of individual city operations. <br />Nor has either committed as to an operator/administrator should we proceed with <br />the regional concept beyond the demonstration project. These decisions will need <br />to be made prior to the end of the demonstration project. Should either, or both <br />cities, abandon the regional concept, information provided via the demonstration <br />project may be used by either in its decision to construct and operate an RIX or <br />conventional facility. <br />Since SBVMWD is no longer involved in this project, it is necessary to restructure <br />the operations and administration agreements. The three new agreements have been <br />reviewed by Best, Best & Krieger to assure that they are in the best interests of <br />the City of Colton. The agreements have also been approved and signed by the City <br />of San Bernardino. <br />RECCMMENDATION: <br />Staff recommends that the City Council approve, and authorize the Mayor to <br />execute, the attached three agreements for the operation of a regional wastewater <br />treatment demonstration project. <br />Attachments: 3 <br />Page 1 of—_ — Item No <br />
