Rev. 6/21/89 <br />OPERATIONS AND MAINTENANCE AGREEMENT <br />FOR THE <br />COLTON/SAN BERNARDINO REGIONAL TERTIARY TREATMENT <br />AND WATER RECLAMATION SYSTEM (DEMONSTRATION PROJECT) <br />THIS AGREEMENT is made this 1st day of August , 1989, <br />by and between the SANTA ANA WATERSHED PROJECT AUTHORITY ("SAWPA") <br />and the CITY OF SAN BERNARDINO, acting by and through its Board of <br />Water Commissioners ("CITY") (sometimes collectively referred to <br />herein as the "PARTIES"). <br />RECITALS <br />A. By means of that certain written agreement dated <br />1989, which agreement is entitled "COORDINATED <br />OPERATING AGREEMENT" (the "COORDINATED AGREEMENT"), by and between <br />the CITY OF COLTON ("COLTON") and CITY, COLTON and CITY have agreed <br />to jointly pay the costs of leasing, operating and maintaining a <br />demonstration -scale REGIONAL TERTIARY TREATMENT AND WATER <br />RECLAMATION SYSTEM (hereinafter the "Demonstration System") for <br />tertiary treatment and disposal of secondarily -treated wastewater <br />generated within the respective service areas of COLTON and CITY. <br />B. Pursuant to the COORDINATED AGREEMENT, SAWPA was <br />appointed the administrator of the Demonstration System, and is <br />authorized to, among other things, negotiate and execute an <br />agreement between SAWPA and CITY wherein SAWPA would delegate to <br />CITY all responsibilities for operating and maintaining the <br />Demonstration System. <br />
