Rev. 6/21/89 <br />ACQUISITION AND ADMINISTRATION AGREEMENT <br />FOR THE <br />COLTON/SAN BERNARDINO REGIONAL TERTIARY TREATMENT <br />AND WATER RECLAMATION SYSTEM (DEMONSTRATION PROJECT) <br />THIS AGREEMENT is made and is effective this 1st day of <br />August 1 , 1989, by and among the CITY OF COLTON, a public <br />agency ("COLTON"), the CITY OF SAN BERNARDINO, a public agency, <br />acting by and through its Board of Water Commissioners ("SAN <br />BERNARDINO"), and the SANTA ANA WATERSHED PROJECT AUTHORITY, a <br />joint powers public agency ("SAWPA") (sometimes collectively <br />referred to herein as the "PARTIES"). <br />RECITALS <br />A. Each of the PARTIES is empowered by law to own and <br />operate wastewater treatment and water reclamation plants. By means <br />of that certain written agreement dated _ �v, 1989, <br />which agreement is entitled "COORDINATED OPERATING AGREEMENT" (the <br />"COORDINATED AGREEMENT"), by and between COLTON and SAN BERNARDINO, <br />COLTON and SAN BERNARDINO have agreed to jointly pay the costs of <br />leasing, operating and maintaining a demonstration -scale REGIONAL <br />TERTIARY TREATMENT AND WATER RECLAMATION SYSTEM (hereinafter the <br />"Demonstration System") for tertiary treatment and disposal of <br />secondarily -treated wastewater generated within the respective <br />service areas of SAN BERNARDINO and COLTON. <br />B.
