Mt, Vernon Ave. <br />Our investigation into the circumstances surrounding the claim you recently presented to the Cite <br />Of Colton has been completed. <br />The City has advised that on May 24, 2000 there was a power outage that affected your area. <br />This outage was caused by a pole that caught fire and broke in two. The City could find no <br />reason why the pole caught fire. <br />During our recent telephone conversation, I discussed with you the City's Resolution *3734, #l3, <br />entitled "Interruptions or Defects in Service," Section B entitled "Uncontrollable Forces." which <br />states: "The City shall not be liable on account of interruptions to service or by reason of any <br />claim or loss for damage resulting therefrom caused by uncontrollable forces, the term <br />`uncontrollable forces,' being deemed for the purposes of these customer service policies to <br />mean flood, earthquake, storm, lightning, fire, epidemic, failure of facilities, war, riot, civil <br />disturbances, labor disturbances, restraint by court or public authority, or any like cauge beyond <br />the control of the City.
