CITY OF COLTON AGENDA REPORT For the Council Meeting of June 20, 2000 TO: HONORABLE MAYOR AND CITY CO�NCIL APPROVAL: HENRY T. GARCIA, CITY MANAGEFO FROM: THOMAS K. CLARKE, UTILITY DIRECTOR SUBJECT: ADOPT THE ATTACHED RESOLUTION TO DECLARE THAT EMERGENCY CONDITIONS EXISTED IN SEWER LINES ON WESTERN AVENUE, AND DELEGATING AUTHORITY TO THE UTILITY DIRECTOR TO ORDER ACTIONS REQUIRED AND AUTHORIZE PAYMENT IN THE AMOUNT OF $30,150 TO EL -CO CONTRACTORS FOR REPAIRS MADE TO THE SEWER LINE IDATE: JUNE 12, 2000 BACKGROUND: Each fiscal year, the Wastewater Department obtains a term purchase order for minor repairs to sewer mains, laterals and manholes. The purchase order repairs cannot exceed $5,000. DISCUSSION/ANALYSIS: Emergency sewer line repairs on Western Avenue, south of Colton Avenue is required, and the contractor who was issued the term purchase order performed the necessary work, but the amount exceeded the terms of the purchase order. Section 22050 of the Public Contract Code allows the Council to pass a resolution by a four- fifths vote of its membership declaring that emergency conditions existed and delegating authority to order actions required by that emergency without giving notice for bids to let contracts. ENVIRONMENTAL IMPACT: None FINANCIAL IMPACT: The FY99-00 Wastewater Budget included sufficient funds in the Emergency, Unscheduled Sewer Line repairs in Account No. 522-8200-8200-2303 to cover the costs of the repairs. RECOMMENDATION: Staff recommends that Council adopt the attached Resolution Declaring Emergency Conditions at the locations stated above, delegating authority to the Utility Director to order actions required, and authorizing payment in the amount of $30,150 to EI -Co Contractors for repairs made to the sewer lines.
