San Bernardino COUnties, indicated he was a member of the AMIGA group and had helped <br />develop this area annexed to Colton. He said it was a piece of property where three-fourths <br />is located in Colton with the balance in Riverside, Three cities in two counties are working <br />to attract industries and jobs. With a possible job Opportunity for 10 employees and a <br />minimum of $30,000 per year sales tax, he stressed the need for a reasonable and equitable <br />application of -fees. He requested a fair play situation and asked the Council to review the <br />fee and the underlying policy. <br />Principal Planner Gabriel provided criteria and factors used to determine traffic fee, <br />authorized by ordinance, which would be used for public improvements, i.e., Curb and gutter, <br />streets, traffic lights, and the like, COUncilt-nember Beltran asked if the City"s fees were <br />consistent. Mr. Gabriel replied that -they were sirnilar. Mr. Beltran questioned the wide <br />difference between -the initial and final fee determinations, City Manager Lewis agreed and <br />indicated that he was not happy with the process which LJSeS primary uses as the basis for <br />equation. He saw the need for the establishment of a more clear policy to develop more <br />consistent analysis. He stated that he would argue for the higher amount, Councilmember <br />Sandoval inquired about Justifying the, number of trips times a set price. City Manager Lewis <br />explained that the traffic fee is based on square footage and not trips. Councilmember <br />Sandoval expressed that he is not in favor of seeing a reduction unless the matter has been <br />referred to staff for further study and report.. Councilmernber Cisneros Suggested that <br />perhaps a change of fee identification. It is not only traffic fees. <br />City Attorney Brown advised that the pUblic hearing not be closed and be allowed to remain <br />ther testir-nony, <br />open for the purpose of taking fur <br />Motion by Councilmernber Sandoval, secor-ided by Councilmernber Beltran to refer the matter <br />of equitable determination arid collection of Traffic Impact Fees to staff for study and <br />recommendation; to keep public hearing open and continue public hearing carried. <br />Unanimous vote, <br />STAFF REPORTS <br />PUBLIC UTILITIES DIRECTOR'S REPORTS AND. -RECOMMENDATIONS: <br />Public Utilities Director Decker reported that the City is required to update its Pre-treatment <br />Ordinance to include new laws arid regulations to enable staff to enforce the laws and <br />regulations to comply with both the Federal and State reqUirements. Staff recommended <br />approval and first reading of the Amendment to Ordinances Nos. 0-1-91 and 0-1-92. <br />Councilmember Bennett asked for clarifica-tion of the words "slug" and "sludge," She asked <br />if this was to bring us in line wi-th -tertiary treatr-rient. Mr. Decker provided clarification of the <br />words and indicated that this legal update is to assist the City in meeting toxic demands and <br />to meet certain discharge limitations.
