consistently advised that elimination of civil service protection <br />for department heads could only apply to prospective employees <br />because of the property interest department heads acquire over time <br />in their positions. <br />Brunick, Alvarez & Battersby in a legal opinion, concluded that <br />elimination of civil service protection for current department <br />heads may only be accomplished by consent of each current <br />department head or through the establishment of a formal bargaining <br />unit that would then meet and confer with the City regarding this <br />issue. <br />City Attorney Biggs stated that based on the above opinion the <br />proposed ordinance was rewritten to apply only to individuals hired <br />into positions newly excluded from civil service protection. City <br />Attorney Biggs emphasized that amendment to Municipal Code Section <br />2.48.050 also applied to elective officers; members of appointive <br />boards, commissions and committees; persons engaged under contract <br />to supply expert technical or professional services for a definite <br />period of time; volunteer personnel; the City Manager and City <br />Attorney; department heads hired after the effective date of this <br />ordinance and part-time and temporary, hourly paid employees. <br />Based on legal opinion, City Attorney Biggs recommended that the <br />second reading of Ordinance No. 0-08-94 be approved as re -written. <br />Motion by Councilmember Bennett, seconded by Councilmember <br />Sandoval, to waive full reading and pass second reading of <br />Ordinance No. 0-08-94.
