^-. <br />SPECIAL CITY COUNCIL MEETING <br />FEBRUARY 11, 1994 <br />In accordance with notice duly and legally given, a Special Meeting <br />of the City Council of the City of Colton was held on the above <br />given date at 6:00 p.m., in the Council Chambers of City Hall, <br />Mayor Gonzales presiding. <br />ROLL CALL: <br />Councilmembers present were Sandoval, Rios, Cook, Beltran, and <br />Mayor Gonzales. Also present were City Manager Young, City <br />Attorney Biggs and City Clerk Ramos. Councilmembers absent were <br />Bennett and Cisneros. <br />CLOSED SESSION• <br />Mayor Gonzales announced the Council adjournment to Closed Session <br />pursuant to Government Code Section 54956.9(c) regarding pending <br />litigation. Councilmember Beltran asked for clarification on the <br />purpose of the Closed Session and in particular the referenced code <br />section. <br />City Attorney Biggs advised the Closed Session is called under the <br />provision of the "Brown Act". She declared Government Code <br />Section 54956.9(c) is when "based on existing facts and <br />circumstances, the legislative body of the local agency has decided <br />to initiate or is deciding whether to initiate litigation". <br />The Council adjourned to Closed Session at 6:10 p.m. and reconvened <br />at 6:42 p.m. All members present as before. <br />City Attorney Biggs read the following into the minute record: "A <br />Special Meeting of the Colton City Council was held on February 11, <br />1994 commencing at 6:00 p.m. The City Council, on advice of the <br />City Attorney and based upon existing facts and circumstances <br />indicating that a significant exposure to litigation against the <br />City had arisen or that the City was considering initiating <br />litigation, adjourned to closed session pursuant to Section <br />54956.9(b)(1) and (c) to discuss that potential litigation. Upon <br />the recommendation of the City Manager, approval was given by the <br />City Council to the City Attorney to request the San Bernardino <br />District Attorney to initiate an investigation into certain matters <br />of concern to the City Council. The nature of these concerns and <br />the names of any potential defendants or other parties who may <br />become involved in that investigation will be revealed as required <br />by California law at a time and in a manner that will not <br />jeopardize service of process should formal proceedings be <br />initiated". <br />1 <br />F 1:3 11 1994 <br />
