At 7:25 p.m. Mayor Fulp declared the meeting adjourned to Closed Session and at 7:55 p.m. <br />meeting reconvened with Mayor Fulp, Councilmember Hansen, Councilmember Bennett, <br />Councilmember Cook, Councilmember Beltran present. Councilmember Hutton and <br />Councilmember Sanders absent. <br />City Attorney Biggs announced that the City Council did meet in Closed Session and announced <br />that, by a vote of 4 to 3, recommendation was made to appoint Interim City Manager Freeman <br />to the permanent position of City Manager and requested approval and adoption of Resolution <br />No. R -125A-96. <br />Motion/second, by Mayor Fulp/CM Beltran, to approve and adopt Resolution No. R -125A-96, <br />Motion carried with Councilmember Bennett voting "NO" and Councilmember Hutton and <br />Councilmember Sanders absent. <br />RESOLUTION NO. R -125A-96 A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF COLTON APPOINTING THE CITY <br />MANAGER AND SETTING COMPENSATION <br />City Attorney Biggs announced that the City Council did meet in Closed Session Pursuant to <br />Government Code Section 54956.9(b) to consider the following matters of pending litigation: <br />Ehrlich v. Culver City which is a amicus brief and the City Attorney's action in joining in that <br />brief on behalf of the City of Colton was ratified and affirmed by consensus of the Council; <br />Young v. City of Colton and declared no reportable action taken; Turner v. Fuln and reported <br />that Mayor Fulp and Councilmember Beltran were excused during discussion of this matter and <br />there was a consensus by Council to extend coverage for legal defense. Motion/second, by CM <br />Hansen/Bennett, to pay for legal defense in the matter of Turner v. Fub with a cap of $88,000. <br />Motion carried with Councilmember Hutton and Councilmember Sanders absent. City Attorney <br />Biggs clarified that Mayor Fulp and Councilmember Beltran declined to vote due to a potential <br />conflict of interest, however, their presence confirms the necessary quorum; and People v.
