Mayor Gaytan re -opened the Public Hearing. <br />City Clerk Barrera announced that Notice of Continuation was posted and that no objections or <br />protests were received. <br />After his report, Community Development Director Zamora recommended passage of the <br />ordinance amending Chapter 15.48 of the Municipal Code, to prevent a constitutional challenge <br />to the Mobilehome Park Rent Stabilization Ordinance, <br />Howard Schaer, a former member of the Rent Stabilization Commission, opposed the <br />amendment, specifically, vacancy control. He stated the original ordinance had been enacted by <br />the vote of the people, in 1989. He urged that the Ordinance on Rent Control remain as is <br />pending further action, or in the alternative, he suggested a 5 % raise limit on vacancy control. <br />Clay Hage, Regional Representative for the Western Mobil Home Park Owners Association, <br />supported the amendment for vacancy decontrol. <br />MOTION/VOTE: Motion/second by Mayor Gaytan/CM Sanders to terminate the Public Hearing <br />carried with no objection. <br />City Manager Garcia suggested that the item be continued to the July 21" meeting, to provide the <br />City Attorney, the Community Development Director and himself, the opportunity to review he <br />initiative to determine its legal parameters and its applicability to the proposed ordinance. <br />Motion/second made by Mayor Gaytan/CM Sanders to waive full reading and pass First Reading <br />of Ordinance No. 0-12-98. After discussion, motion carried with CM Chastain, Bennett and <br />Grimsby voting "No." <br />RECHE CANYON REHABILITATION.
