Item 11 - MOTION/VOTE: After discussion, motion made by CM Bennett to approve <br />RESOLUTION NO. R-90-98, as amended to include the language "...and/or three axles or <br />more." after each designation of "commercial vehicles two tons..." with the acknowledgement <br />that vehicles 10,000 pounds or less are under different requirements. [No second was requested <br />at this time.] <br />Item 18 - In response to inquiry, CM/Public Works Director Hutton identified Marshall Partain <br />as the person who would be traveling. <br />MOTIONNOTE: Motion/second by Mayor Gaytan/CM Sanders to approve the Consent <br />Calendar, except for Items Nos. 7, 8, 11 and 17, carried with CM Bennett specifically abstaining <br />from approving the minutes of July 14, 1998, based on the fact that she was not present. <br />Item 7 - Tim Trewyn made presentation on the merits of Metricom, a wireless data communications <br />network, for connection of laptop computers to the Internet regardless of its location. <br />MOT11ONNOTE: CM Bennett moved for approval of Staff s recommendation. City Attorney <br />Associate Derleth submitted changes to the following terms: <br />Section 4.2, line 2, stated the fee amount as "... $60 per radio, per pole..." <br />Section 5.3, revised the first sentence, to read "Whenever the installation, operation ... is <br />conducted under this Permit,... <br />Section 6.2, last two lines, inserted the word "operation7 after "or occasioned by the <br />installation,..." <br />Section 6.3, after the heading, added "to the extent" after the words "...cost of repair to <br />damaged Radios... " <br />Section 8, the City Engineer will also receive notices. <br />Section 9, the last sentence regarding default is deleted in toto. <br />Section 11.9, the last five lines shall read "...the City; provided, however, that in no event shall <br />such Regulations substantially impair the benefits to Metricom, or this permit." <br />After discussion, CM Bennett withdrew the initial motion. As requested and with consensus of <br />Council, Mayor Gaytan pulled Agenda Items Nos. 7 and 8, to allow time for study of the issue. <br />Item I I — MOTIONNOTE: Motion/second by CM Sanders/Bennett to approve RESOLUTION <br />NO.
