This was the time and place continued to for the consideration of a replacement ordinance for <br />Ordinance No. 0-18-87 and its amended Ordinance No. 0-01-92 with newly adopted F.E.M.A. <br />recommended Floodplain Management Ordinance. <br />Mayor Pro Tempore Bennett declared the Public Hearing "open" and called for comments. <br />Assistant City Clerk submitted the affidavit of publication and reported there were no protests or <br />objections. <br />Assistant City Manager Parrish indicated that the proposed action was for the purpose of updating <br />the floodplain management ordinance to meet the minimum federal requirements. <br />There was no response to the call for public comment. Motion/second by CM Sanders/Ramos to <br />terminate the public hearing carried upon unanimous vote. <br />MOTION/VOTE: Motion/second by CM Sanders/Chastain to waive full reading and pass first <br />reading of ORDINANCE NO. 0-01-01, an ordinance of the City of Colton amending Chapter <br />15.18, Title 15 of the Colton Municipal Code regarding Floodplain Management Regulations. <br />Motion carried upon unanimous vote. <br />PUBLIC COMMENT: <br />The following persons addressed the City Council: William Yalm and Jose Zendejas. <br />Staff Reports: <br />City Attorney's Reports and Recommendations: <br />Filling of Mayoral Vacancy <br />By consensus of City Council, this item was advanced on the agenda. City Attorney Carvalho <br />stated the rules on filling the mayoral vacancy that occurred on January 16, 2001. <br />Charles Jackson commented on this item. <br />MOTION/VOTE: After discussion, on motion/second by CM Chastain/Sanders to proceed with <br />the appointment a mayor carried with CM DeLaRosa and CM Zamora voting "No." <br />In response to inquiry on vacant seats, City Attorney Carvalho stated that a vacancy occurred at <br />the time the existing seat was vacat ' ed by resignation or by accepting another office so that if an <br />existing member of City Council was appointed, that person's seat would become vacant on the <br />day of the swearing in and that would then start the 30 -day rule in terms of filling that position by <br />appointment or by election, for the existing term. She said the law held that no more than a <br />majority of people holding positions can be appointed, so that if Council experienced a third <br />vacancy and it chose to appoint that position, Council would lose the ability to appoint the fourth <br />person and the City would be forced to have an election.
