Mayor Bennett declared the Public Hearing "Open". City Clerk Barrera said the Affidavit of Publication and Reports on Protests or Objections Thereto was on file in the City Clerk's Office and stated that no protests or objections were received. Mayor declared the Public Hearing Open. Community Development Director Zamora presented for consideration and approval of staff's recommendation Mayor Bennett asked legal counsel if there was a conflict as she lived in the specific plan area and based on his opinion she excused herself from the dais. Mayor Pro Tempore Chastain continued the meeting. Motion/second by CM De La Rosa/Ramos to terminate public hearing. Motion carried with Mayor Bennett absent due to a conflict. Motion/second by CM De La Rosa/Ramos to approve and adopt RESOLUTION NO. R-34-03 (E!R); waive full reading and approve first reading of ORDINANCE NO. 0-07-03 (Specific Plan Amendment), and approve and adopt RESOLUTION NO. R-35-03 (Tract Map #16289). Motion carried with Mayor Bennett absent due to a conflict. Mayor Bennett returned to the dais and continued the meeting. Motion/second by CM Ramos/De La Rosa to waive full reading and pass second reading of an Ordinance regarding Construction Tax Ordinance Repeal, ORDINANCE NO. 0-06-03. Unanimous vote.
