<br />at all the times herein mentioned had and still
<br />has a bona fide subscription list of paying sub-
<br />scribers, and which newspaper has been estab-
<br />lished, printed and published at regular intervals
<br />in the said City of Colton, State of California,
<br />County of San Bernardino, for a period exceeding
<br />one year next preceding the date of publication of
<br />the notice hereinafter referred to; and which news-
<br />paper is not devoted to nor published for the in-
<br />terests, entertainment or instruction of a particular
<br />class, profession, trade, calling, race, or denomin-
<br />ation, or any number of some; that the notice, of
<br />which the annexed is a printed copy, has been
<br />published in each regular and entire issue of said
<br />newspaper and not in any supplement thereof on

<br />ORDINANCE NO. 1665
<br />AN ORDINANCE AMEN-
<br />DING ORDINANCE NO. 965, AN
<br />ORDINANCE REGULATING
<br />THE MOVING OF BUILDINGS
<br />AND OVERSIZED LOADS AND
<br />REPEALING ORDINANCE
<br />#1002.
<br />THE CITY COUNCIL of theCi-
<br />ty of Colton does ordain as
<br />follows:
<br />SECTION ONE. That Section
<br />Three, Subsection 1 of Ordinance
<br />No. 965 shall be amended and
<br />read as follows:
<br />I. The fee to be paid for filing
<br />an application for a permit to
<br />move oversize loads and for
<br />moving buildings, not Intended to
<br />be located in the City shall be the
<br />sum of 10.00 plus such other
<br />amounts as the City may be
<br />obliged to incur as costs and ex-
<br />penses by reason of any such
<br />move. Said fee may be changed
<br />from time to time by Resolution
<br />adopted by the City Council.
<br />SECTION TWO. That Section
<br />Eleven of Ordinance No. 965 Is
<br />hereby amended to read as
<br />follows:
<br />SECTION 11. PROCEDURE
<br />AFTER APPLICAITON AP-
<br />PROVED. After the approval of
<br />any application for the moving of
<br />a building to be located within
<br />the City of Colton, and before any
<br />permit shall be isssued therefor,
<br />the applicant, notwithstanding
<br />any of the other provisions
<br />herein, shall execute and file
<br />with the City of Colton and agree-
<br />ment satisfactory to the City of
<br />Colton to complete the work
<br />shown by the plans and specifica-
<br />tions or otherwise required,
<br />within a reasonable time as pro-
<br />vided in said agreement, but not
<br />exceeding (6) months from the
<br />date thereof, and the applicant
<br />as a further condition precendent
<br />to the Issuance of such permit
<br />shall furnish the City with a
<br />faithful and performance bond In
<br />form satisfactory to the City, In
<br />favor of the City, In an amount
<br />equivalent to 125% of the
<br />estimated cost thereof, as
<br />estimated by the City, or In lieu
<br />thereof, a cash bond of the same
<br />amount, and said costs may In-
<br />clude In addition to other work
<br />that may be required, the cost of
<br />termite control, and the con-
<br />struction of curbs, gutter
<br />sidewalks when deemed ad-
<br />visable by the City, and as a fur-
<br />ther condition precedent to the
<br />granting of any such permit for
<br />any oversized load, the applicant
<br />shall furnish the city a cash bond
<br />or public liability and property
<br />Insurance policy issued by a
<br />standard Insurance company
<br />licensed by the State of Callfor-
<br />nia in such amoi a' as the
<br />Superintendent of Streets deems
<br />advisable or In lieu thereof to fur-
<br />nish such evidence as may be
<br />satisfactory to the Superinten-
<br />dent of Streets that any such ap-
<br />,I plicant has and will have at all
<br />times during the time the permit
<br />shall be In effect such a policy
<br />fully Insuring the City of Colton
<br />from any and all Ilabllty of any
<br />nature whatsoever, and to hold
<br />the City of Colton free and
<br />harmless for any property or
<br />personal damage or Injury caus-
<br />ed directly or Indirectly by any
<br />such moving.
<br />SECTION THREE. That Or-
<br />dinance #1002 Is hereby repealed.
<br />SECTION FOUR. The City
<br />Clerk shall certify to the passage
<br />of this ordinance and shall cause
<br />the same to be published once In
<br />the Colton courier, a daily
<br />newspaper hereby designated
<br />for that purpose.

<br />PROVED this 7th day of August,
