S... he is not a party to, nor interested in the above entitled matter; that ......She is the principal clerk of the printer of the Colton Courier, a newspaper of general circulation, printed and published in the City of Colton, State of California, County of San Bernardino, and which newspaper is published for the dissemination of local news and intelli- gence of a general character, and which newspaper at all the times herein mentioned had and still has a bona fide subscription list of paying sub- scribers, and which newspaper has been estab- lished, printed and published at regular intervals in the said City of Colton, State of California, County of San Bernardino, for a period exceeding one year next preceding the date of publication of the notice hereinafter referred to; and which news- paper is not devoted to nor published for the in- terests, entertainment or instruction of a particular class, profession, trade, calling, race, or denomin- ation, or any number of some; that the notice, of which the annexed is a printed copy, has been published in each regular and entire issue of said newspaper and not in any supplement thereof on the following dates, to -wit: August 16, 1984 .............................................................................. ORDINANCE NO. 1665 AN ORDINANCE AMEN- DING ORDINANCE NO. 965, AN ORDINANCE REGULATING THE MOVING OF BUILDINGS AND OVERSIZED LOADS AND REPEALING ORDINANCE #1002. THE CITY COUNCIL of theCi- ty of Colton does ordain as follows: SECTION ONE. That Section Three, Subsection 1 of Ordinance No. 965 shall be amended and read as follows: I. The fee to be paid for filing an application for a permit to move oversize loads and for moving buildings, not Intended to be located in the City shall be the sum of 10.00 plus such other amounts as the City may be obliged to incur as costs and ex- penses by reason of any such move. Said fee may be changed from time to time by Resolution adopted by the City Council. SECTION TWO. That Section Eleven of Ordinance No. 965 Is hereby amended to read as follows: SECTION 11. PROCEDURE AFTER APPLICAITON AP- PROVED. After the approval of any application for the moving of a building to be located within the City of Colton, and before any permit shall be isssued therefor, the applicant, notwithstanding any of the other provisions herein, shall execute and file with the City of Colton and agree- ment satisfactory to the City of Colton to complete the work shown by the plans and specifica- tions or otherwise required, within a reasonable time as pro- vided in said agreement, but not exceeding (6) months from the date thereof, and the applicant as a further condition precendent to the Issuance of such permit shall furnish the City with a faithful and performance bond In form satisfactory to the City, In favor of the City, In an amount equivalent to 125% of the estimated cost thereof, as estimated by the City, or In lieu thereof, a cash bond of the same amount, and said costs may In- clude In addition to other work that may be required, the cost of termite control, and the con- struction of curbs, gutter sidewalks when deemed ad- visable by the City, and as a fur- ther condition precedent to the granting of any such permit for any oversized load, the applicant shall furnish the city a cash bond or public liability and property Insurance policy issued by a standard Insurance company licensed by the State of Callfor- nia in such amoi a' as the Superintendent of Streets deems advisable or In lieu thereof to fur- nish such evidence as may be satisfactory to the Superinten- dent of Streets that any such ap- ,I plicant has and will have at all times during the time the permit shall be In effect such a policy fully Insuring the City of Colton from any and all Ilabllty of any nature whatsoever, and to hold the City of Colton free and harmless for any property or personal damage or Injury caus- ed directly or Indirectly by any such moving. SECTION THREE. That Or- dinance #1002 Is hereby repealed. SECTION FOUR. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published once In the Colton courier, a daily newspaper hereby designated for that purpose.
