1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-5-86 <br />AN INTERIM URGENCY ORDINANCE OF THE CITY OF COLTON <br />ESTABLISHING A MORATORIUM PROHIBITING NEW RESIDENTIAL <br />USES IN AN AREA OF THE CITY PENDING STUDY. <br />WHEREAS, Government Code Section 65858 authorizes the <br />adoption as an urgency matter of an interim ordinance prohibiting <br />uses in an area under certain circumstances, and <br />WHEREAS, the City Council intends to prohibit any uses <br />which may be in conflict with a contemplated general plan, specific <br />plan, or zoning proposal which the City Council, Planning Commis- <br />sion and Planning Department are considering or studying or intend <br />to study within a reasonable time, and <br />WHEREAS, West Valley Redevelopment Project study area <br />(herein "The Area") is under consideration as to prohibiting resi- <br />dential uses therein. <br />THE CITY COUNCIL OF THE CITY OF COLTON ORDAINS: <br />1. The City Council makes a finding that there is a <br />current and immediate threat to the public health, <br />safety, or welfare, and that the approval of <br />additional subdivisions, use permits, variances, <br />building permits, or any other applicable entitlement <br />for use which is required in order to comply with a <br />zoning ordinance would result in a threat to public <br />health, safety, or welfare. <br />2. New Residential Uses are prohibited in The Area <br />described in Exhibit "A" attached. <br />3. Unless extended as provided by law, this ordinance <br />1 <br />
