area, but prohibits the City from requiring more than five (5) acres of park area for each 1,000 population; and WHEREAS, the City Council has determined that the ratio of the total amount of area of active and passive recreational areas and park lands within the City of Colton is to the population of the City, as provided by Government Code Section 66477, exceeds three (3) acres per one thousand (1,000) population; and WHEREAS, the City Council has determined that the computation of the in lieu fee should be based upon the product of the foregoing ratio, the residential density as measured by the number of dwelling units and the occupancy of such units, and the actual land value of the property which would otherwise be required for dedication; and WHEREAS, the City Council determines that the adoption of this Ordinance will promote the public health, safety, and welfare; is reasonably necessary to meet public needs arising as a result of subdivision; and is consistent with the provisions of State law; and WHEREAS, Government Code Sections 65858, 36937, and 65962 permit the adoption of interim authorization for such fees and charges when necessary for the immediate public health, welfare, and safety. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the Colton Municipal Code is hereby amended by adding Chapter 16.58, which chapter shall read as follows: "Chapter 16.58 DEDICATION OF LAND OR PAYMENT OF FEES FOR PARK AND RECREATIONAL PURPOSES Sections: 16.58.010 Park and Recreation Dedication and Fees 16.58.020 Definitions 16.58.030 Park Dedication Required 16.58.040 Standards For Determining Dedication 16.58.050 Fees in Lieu of Dedication 16.58.060 Determination of Dedication, Fees, or Combination 16.58.070 Subdivider Credits 16.58.080 Disposition of Land or Fees -2-
