z <br />3 <br />4 <br />5 <br />s <br />s <br />9 <br />10 <br />11 <br />12' <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0 2 0- 8 8 <br />AN ORDINANCE OF THE CITY COUNCIL <br />OF THE CITY OF COLTON PROHIBITING <br />THE DISPLAY FOR SALE OR SALE OF <br />REPLICA FIREARMS AND PENALTY FOR <br />VIOLATION THEREOF <br />THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA ORDAINS: <br />There is hereby added to the Municipal Code of Colton Section <br />9.040.050 which is to read as follows: <br />9.040.050 <br />(A) No person shall display for sale or sell a replica or <br />facsimile of a firearm within the City of Colton. <br />(B) As used in this chapter, the meaning of the terns firearm <br />shall be the same as the meaning of that term under the "Dangerous Weapons' <br />Control Law" located at Section 12000 et seq of the Penal Code of the State <br />of California. A "replica or facsimile of a firearm" shall include any <br />device or object made of plastic, wood, metal or any other material, which <br />can reasonably be perceived to be an actual firearm, but is not an actual <br />firearm. Such tern does not include any non -firing replica of an antique <br />firearm, the original of which was designed, manufactured and produced prior <br />to 1898. <br />(C) Any person, corporation, firm or association of persons who <br />violates the provisions of Section 9.40.050 shall be guilty of a misdemeanor <br />punishable by imprisonment in jail, not exceeding six months, or by fine, <br />not exceeding one thousand dollars, or by both. <br />This ordinance shall take effect thirty days from the date of <br />adoption. <br />Adopted: June 7 , 1988 <br />ATTEST: <br />�d a . �� <br />CITY CLERK <br />
