Section 4. Section 6(D) of Ordinance No. 1578 is <br />hereby amended to read as follows: <br />"Grantee will establish and maintain a local business <br />office within the corporate limits of the City of Colton <br />where all Colton residents may pay their cable television <br />bills and return converter boxes." <br />Section 5. Section 6(F) of Ordinance No. 1578 is <br />hereby deleted. <br />Section 6. Section 6(G) of Ordinance No. 1578 is <br />hereby deleted. <br />Section 7. Section 6(I) is hereby amended to read as <br />follows: <br />"One full-time government/school access channel, one <br />full-time educational access channel; and one full-time City <br />access channel are committed. Colton shall possess the right <br />and technical ability to preempt, upon reasonable notice, any <br />programming upon the public -access government channel at any <br />time and assert its own programming by way of the reverse <br />link from City Hall. An emergency alert system, as described <br />below, for use by the City of Colton, operated by the City, <br />will be given to the City and maintained by the Grantee for <br />the City's use. Said emergency alert system shall possess <br />audio alert only capacity whereby Colton, through the use of <br />a special code and dedicated phone line, can silence the <br />audio portion of all channels on the ACT -4 Colton System and <br />broadcast an audio message on all such channels including but <br />not limited to a message directing subscribers to the public <br />access/government channel. Colton shall indemnify and hold <br />harmless ACT -4 from any claims for damages, including <br />attorneys' fees, arising from the City's negligent or <br />improper use of the systems emergency override capabilities <br />as referenced in this section." <br />Section 8. Section 6(L) of Ordinance No. 1578 is <br />hereby deleted. <br />Section 9. Section 8 of Ordinance No. 1578 is hereby <br />amended to read as follows: <br />"Grantee hereby expressly agrees to be bound by the <br />terms and conditions of its proposal to the City of Colton <br />dated October 31, 1978, a copy of which is attached to this <br />franchise as Exhibit "A" incorporated herein except where <br />said proposal is inconsistent with Chapter 5.06 of the Colton <br />Municipal Code, this Ordinance, or the Settlement Agreement." <br />Section 10. The first paragraph of Chapter 5.06.060 <br />of the Colton Municipal Code is hereby amended to read as <br />follows: <br />-2- <br />
