It is unlawful <br />for any person to conduct, or participate in the conduct of, <br />sales of personal property to the general public by means of <br />a "garage" sale, "patio" sale, "yard" sale, or other sale <br />similarly conducted on any residentially zoned premises, except <br />as permitted in this chapter or authorized by the zoning ordi- <br />nance (No. 964) or other law. (Ord. 1483 (part), 1975). <br />5.45.020 Application and permit. Any person (herein the <br />applicant) intending to conduct a "garage" sale, "patio" sale, <br />"yard" sale, or similar sale of personal property to the <br />general public on residentially zoned premises or from a <br />residence or residential garage shall, concurrently with the <br />payment of a two -dollar fee, file an application with the city <br />finance department. The applicant shall declare under penalty <br />of perjury, or by affidavit, in the application, that all <br />iter,.s to be sold are lawfully possessed, owned, utilized and <br />maintained by such applicant in cDnnecticn with the use of <br />the premises and have r:Dt been acquired, possessed, or con- <br />signed for the sale. Only one such sale <br />may be conducted at a particular place in any six-month period. <br />No sale shall continue more than three days. Sales shall be <br />conducted between the hours of eight a.m. and eight p.m. only. <br />A permit shall be issued for only one location. (Ord. 1483 <br />(part) , 1975) . <br />
