ORDINANCE NO. 0-10-90 <br />AN ORDINANCE OF THE CITY OF COLTON <br />APPROVING THE AMENDED GATLIN/BERGER <br />DEVELOPMENTS, INC. DEVELOPMENT AGREEMENT <br />BE IT ORDAINED by the City Council of the City of <br />Colton as folows: <br />f inds : <br />Section 1. <br />Findings. The City Council hereby <br />(i) On May 15, 1990, the City Council adopted <br />Ordinance No. 0-4-90 approving a Development Agreement (the <br />"Development Agreement") for approximately 24.78 acres of <br />land (the "Property") located in that portion of the City <br />zoned under the Cooley Specific Plan and owned by <br />Gatlin/Berger Developments, Inc. (the "Property Owner"), a <br />Louisiana corporation. <br />(ii) The parties to the Development Agreement have, <br />prior to its execution of the Development Agreement, agreed <br />that the terms of the Development Agreement should be <br />altered, and thus have, in compliance with state and local <br />laws, arranged for the reconsideration of the Development <br />Agreement by the City. <br />(iii) On August 7, 1990, after publication, posting <br />and mailing of notices thereof as required by law, the City <br />Council conducted a public hearing on the proposed Amended <br />Development Agreement, and received testimony and <br />information from any and all parties; <br />
