ORDINANCE NO. 0-10-90 AN ORDINANCE OF THE CITY OF COLTON APPROVING THE AMENDED GATLIN/BERGER DEVELOPMENTS, INC. DEVELOPMENT AGREEMENT BE IT ORDAINED by the City Council of the City of Colton as folows: f inds : Section 1. Findings. The City Council hereby (i) On May 15, 1990, the City Council adopted Ordinance No. 0-4-90 approving a Development Agreement (the "Development Agreement") for approximately 24.78 acres of land (the "Property") located in that portion of the City zoned under the Cooley Specific Plan and owned by Gatlin/Berger Developments, Inc. (the "Property Owner"), a Louisiana corporation. (ii) The parties to the Development Agreement have, prior to its execution of the Development Agreement, agreed that the terms of the Development Agreement should be altered, and thus have, in compliance with state and local laws, arranged for the reconsideration of the Development Agreement by the City. (iii) On August 7, 1990, after publication, posting and mailing of notices thereof as required by law, the City Council conducted a public hearing on the proposed Amended Development Agreement, and received testimony and information from any and all parties;
