1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Prior to the issuance of building permits for any residential dwelling, the <br />developer shall file a list of Features and Amenities with the Building Official. <br />The list of Features and Amenities shall contain the following information: <br />(A) Each major component to be installed in each residential dwelling <br />including, but not limited to, refrigerators, stoves, microwave ovens, dish- <br />washers, garbage disposals, trash compactors, heating and air conditioning <br />units, solar units, vacuum units, swimming pools, spas,patios, landscaping <br />and alarm systems. <br />(B) Any and all representations to be made to the buyers of the <br />residential dwellings pertaining to the features and amenities to be installed, <br />the quality of construction of the residential dwellings including the normal war- <br />ranty that the residential unit will be constructed in a good workmanlike man- <br />ner, and any other representation regarding the developer's efforts to comply <br />with the provisions of this chapter. <br />A. Prior to the issuance of building permits, the developer shall <br />post security for the inspection of each residential dwelling to insure com- <br />pliance with the City's building ordinances, the functionality of the dwelling's <br />major components as contained in the developer's Features and Amenities <br />List, and the developer's warranties. The security to be posted by the <br />developer shall be in the form specified by the building official who may re- <br />quire cash,bonds, letters of credit, or any combination thereof. Both the <br />amount of the security and the form of the security may be appealed to the <br />City Council provided that the developer files an appeal with the City Clerk <br />within ten days of the decision of the building official. And provided that the <br />developer pays the filing fee fixed therefore. <br />B. Such fee is initially fixed at $200.00 and may be changed by <br />resolution adopted by the City Council. <br />C. This ordinance shall apply to developments now being built. As <br />to developments that have a building permit as of the effective date of this or- <br />dinance a security deposit is required. Said security deposit shall be posted <br />forthwith, Pending receipt of such security deposit, no certificate of occupan- <br />cy shall be issued. <br />D. The security deposit is initially fixed at $350. 00 per dwelling unit and may <br />be changed by resolution adopted by the City Council. 30% of this fee will be <br />retained by the City for administrative costs. <br />1 Cord-hom# 3 <br />
