had been arraigned on an infraction complaint <br />1.12.040 Penally for Misdemeanor Volatio s_ Violations of the Municipal <br />Code prosecuted by the City Attorney as misdemeanor offenses shall be punishable by <br />imprisonment in the City Jail or in the San Bernardino County Jail not exceeding six <br />months, or by fine not exceeding one thousand dollars, or by both. <br />1.12.50 Penally for 4.ft dm Violations. Violations prosecuted by the City <br />Attorney as infractions shall be punishable by a fine not exceeding one hundred dollars <br />for a fust violation, a fine not exceeding two hundred dollars for a second violation of <br />the same provision within one year, and a fine not exceeding five hundred dollars for <br />each additional violation of the same provision within one year. An infraction is not <br />punishable by imprisonment. <br />1.12.60 Waiver Q f Rights in Mft6m Prosecutions. A person charged with or <br />prosecuted on an offense as an infraction shall not be entitled to a trial by jury and shall <br />not be entitled to have the public defender or other counsel appointed at public expense <br />to represent him unless he is arrested and not released on his written promise to appear, <br />his own recognizance, or a deposit of bail <br />1.12.70 Continuing Violations. Each person, fnn or corporation shall <br />be deemed guilty of a separate offense, whether misdemeanor or infraction, for <br />each day or portion thereof during which any violation of any provision of this <br />Code is committed, continued or permitted by such person, firm or corporation <br />and shall be punishable as provided Section 1.12040 or 1.12.50 as applicable." <br />Section 2. One complete copy of this ordinance shall be certified to be a true, correct, and <br />complete copy by the City Clerk of Colton and shall be kept on file in the office of the City <br />Clerk <br />
