6.32.042 Allocation of Licenses by Category of Organization <br />Each Calendar year, a total of 12 licenses may be issued by the city. <br />Those licenses shall be distributed to qualified organizations <br />submitting applications as follows: <br />A. Churches/religious organizations --three (3) licenses; <br />B. Youth groups --six (6) licenses; <br />C. Civic organizations --three (3) licenses. <br />The City Council may not consider any requests for additional licenses <br />exceeding the number specified in the current calendar year; however, <br />additional licenses requested may be presented for approval in the <br />following calendar year. <br />In the event that fewer organizations within any category apply for <br />licenses than this Section allocates, the remaining unallocated <br />licenses shall be allocated by lot as provided in Section 6.32.44 of <br />this Chapter. <br />6.32.044 Allocation of licenses by Lot If the number of <br />applications in any organizational category exceeds the number of <br />licenses permitted to be issued in accord with Section 6.32.044 of <br />this Chapter, the Director of Finance shall conduct a drawing to <br />determine which applicants shall be issued licenses. Each applicant <br />subject to selection by lot shall be notified at least five (5) days <br />in advance of the drawing in writing by the City and shall have the <br />right to attend and witness the drawing for such licenses. <br />6.32.050 Sale--License--Notice of grant or denial. Applicants <br />for any such license shall be notified by the finance department of <br />the city by April 15th of the granting or rejection of such <br />application for a license. (Ord. 1493 S2(4), 1976). <br />6.32.060 Temporary sales tax Permit required. Organizations <br />licensed for the selling of fireworks are required to obtain a <br />temporary sales tax permit from the regional office of the State Board <br />of Equalization. (Ord. 1493 S2(10)1 1976). <br />6.32.070 Display of license and sales tax permit. License to <br />sell fireworks and temporary sales tax permit shall be displayed in a <br />prominent place in the fireworks stand. (Ord. 1493 52(11)1 1976). <br />6.32.080 Sale --Operation regulations. <br />A. No person other than the licensee organization shall operate <br />the stand for which the license is issued or share or otherwise <br />participate in the profits of the operation of such stand. <br />B. No person other than the individuals who are members of the <br />licensee organization, or the wives or husbands or children 16 years <br />of age or older of such members, shall sell fireworks at such stand. <br />C. No person shall be paid any consideration for selling or <br />otherwise participating in the sale of fireworks at such stand. <br />D. Licensee shall sell only at the stand described in its <br />application. A licensee shall not operate more than one stand. (Ord. <br />1493 S2(6), 1976). <br />
