ORDINANCE NO. 0-18-92 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />COLTON AMENDING SECTION 15.48.040 OF THE COLTON <br />MUNICIPAL CODE AND ADDING A NEW ARTICLE X TO <br />CHAPTER 15.48 SECTIONS RELATING TO ELIMINATION OF <br />DECONTROL OF RENTS UPON VACANCY SETTING STANDARDS <br />FOR RENTAL AGREEMENTS FOR ALL TENANTS <br />THE CITY COUNCIL OF THE CITY OF COLTON ORDAINS AS FOLLOWS: <br />SECTION 1. Section 15.48.040 B is hereby amended to read as <br />follows: <br />"B. Vacancy. Whenever a vacancy occurs, the initial rent <br />charged to the subsequent tenant who moves a mobile home onto <br />the space left vacant by the previous tenant or to the <br />subsequent owner of a mobile home left in place shall remain <br />the same as that charged to the previous tenant. The base <br />rent applicable to the previous tenant shall remain the same, <br />and the new tenant shall only be subject to rent increases at <br />the time such rent increases would have been applicable to the <br />previous tenant as if no vacancy had occurred." <br />SECTION 2. Section 15.48.040 is hereby amended by the <br />addition of new subsections D and E to read as follows: <br />"D. Any lease or other rental agreement obligations between <br />any existing Tenant and a Park Owner at the time a vacancy <br />occurs shall remain the obligation of the existing Tenant <br />unless such obligations are specifically and voluntarily <br />assumed by any prospective tenant. <br />E. No prospective tenant shall be required to accept as a <br />condition of rental of any space or purchase of any mobile <br />home left in place any rental agreement in force between a <br />Park Owner and any Tenant at the time a vacancy occurs." <br />SECTION 3. A new Article X shall be added to Chapter 15.48 <br />commencing with the existing Section 15.48.670 to read in its <br />entirety as follows: <br />"X. APPLICABILITY OF CHAPTER TO PROSPECTIVE TENANTS <br />AND TERMS PERMITTED IN RENTAL AGREEMENTS <br />15 48 670 Applicability to prospective tenants.
