KRW61346 <br />1 resolution, as the City Council may in its discretion deem <br />2 appropriate, to determine pursuant to the methodology set forth in <br />3 the Rate and Method of Apportionment the specific Special Tax rate <br />4 and the amount to be levied on all non exempt real property within <br />5 the boundaries of the CFD for the next fiscal year within the CFD, <br />6 except that the Special Tax rate and the amount to be levied <br />7 therein shall not exceed those set forth in the Rate and Method of <br />8 Apportionment but the Special Tax may be levied at a rate lower <br />9 than that set forth in the Rate and Method of Apportionment. <br />10 Section 3. No properties or entities within the bounda- <br />it ries of the CFD are exempt from the levy and payment of the <br />12 Special Tax unless the properties or entities are expressly <br />13 exempted by the Act or the Rate and Method of Apportionment. <br />14 Section 4. All of the Special Tax moneys which are <br />15 collected, including the receipt of any proceeds from any judicial <br />16 foreclosure sales due to delinquencies in payment of the Special <br />17 Tax, shall be used as provided for in the Act and the proceedings, <br />18 agreements and Resolutions relating to the formation and estab- <br />19 lishment of the CFD; provided, however that payments of any <br />20 principal of, premium, if any, and interest on the Bonds shall be <br />21 given first priority for payment from Special Tax moneys or <br />22 proceeds from judicial foreclosure sales, if any. <br />23 Section 5. The Special Tax shall be collected in the <br />24 same manner as ordinary ad valorem taxes are collected in the <br />25 County of San Bernardino, State of California (the "County") and <br />26 shall be subject to the same penalties and the same procedure, <br />27 sale and lien priority in cases of delinquency as provided for and <br />28 applicable to the levy and collection of ad valorem taxes in the <br />-4- <br />
