The city attorney shall have the <br />authority to prosecute any violation of the municipal code designated as a misdemeanor <br />as an infraction in the interests of justice. Additionally, the court may determine that <br />the offense is an infraction in which event the case shall proceed as if the defendant had <br />been arraigned on an infraction complaint." <br />SECTION 2: The City Council hereby declares that it would have adopted this ordinance <br />and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact <br />that any one or more sections, subsections, clauses, phrases or portions thereof be declared <br />invalid or unconstitutional. If for any reason, any portion of this ordinance shall be declared <br />invalid or unconstitutional, then all other provisions hereof shall remain valid and enforceable. <br />SECTION 3: The City Clerk shall cause this ordinance or a summary of it to be <br />
