1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />WHEREAS, it is imperative that the City review its building and construction standards <br />to assure that adequate information is available to evaluate the safety of construction in hillside <br />areas of the City regarding compaction issues; and <br />WHEREAS, it is imperative to further the goals and policies of the City's general plan <br />and zoning ordinance that adequate safeguards and building standards be implemented; and <br />WHEREAS, continued issuance of building permits for construction in slope areas <br />without prior review of building standards and procedures used by the City to review such <br />construction for safety and stability could result in additional loss of property, shoddy <br />construction and deteriorating conditions in the slope areas of the City thereby creating an <br />immediate threat to the public health, safety and welfare; and <br />WHEREAS, Government Code Section 65858 authorizes the City Council to adopt as <br />an urgency measure an interim ordinance prohibiting any uses which may be in conflict with <br />general plan, specific plan and zoning proposals which the City is considering or studying or <br />intends to study within a reasonable time. <br />NOW THEREFORE, THE CITY COUNCIL ORDAINS AS FOLLOWS: <br />SECTION 1: The City Council finds and determines the following: <br />(a) The potential for improperly compacted building sites in the slope areas of the City <br />primarily located in the Reche Canyon, La Loma Hills and immediately adjacent hillside <br />areas exists as demonstrated by recent problems in construction appearing in that area. <br />(b) In order to address this problem, the City must conduct a review of its policies <br />and procedures to assure that adequate safeguards are in place to reasonably assure <br />MM <br />
