O-09-94 <br />AN URGENCY ORDINANCE OF THE CITY OF COLTON <br />ESTABLISHING A MORATORIUM ON ISSUANCE OF <br />BUILDING PERMITS FOR CONSTRUCTION OF BUILDINGS <br />IN SLOPE AREAS OF THE CITY OF COLTON WHERE <br />COMPACTION PROBLEMS HAVE BEEN IDENTIFIED <br />WHEREAS, the City Council on March 15, 1994 adopted Ordinance No. 0-05-94 <br />establishing a 45 day moratorium on construction in Reche Canyon, La Loma Hills and <br />immediately adjacent hillside areas so that the City could study its current building standards and <br />determine whether any revisions are advisable to assure the stability of future construction in <br />those areas; and <br />WHEREAS, the City has not yet concluded its review of its building standards as they <br />relate to the problems experienced in the Reche Canyon, La Loma Hills and adjacent hillside <br />areas and has determined that it is necessary to extend the moratorium and to modify its terms <br />in accord with the provisions of Government Code Section 65858. <br />NOW THEREFORE, THE CITY COUNCIL ORDAINS AS FOLLOWS: <br />SECTION 1: The City Council finds and determines the following: <br />(a) The potential for improperly compacted building sites in the slope areas of the City <br />primarily located in the Reche Canyon, La Loma Hills and immediately adjacent hillside <br />areas exists as demonstrated by recent problems in construction appearing in that area. <br />(b) In order to address this problem, the City must conduct a review of its policies <br />and procedures to assure that adequate safeguards are in place to reasonably assure <br />-1- <br />
