1_4ZiVZM 110IN3Wr00of34Zi*Z" <br />This Franchise Agreement ("Franchise") is between the City of <br />Colton hereinafter referred to as "Franchising Authority" and TCI <br />Cablevision of California, Inc. hereinafter referred to as <br />"Grantee." <br />The Franchising Authority, having determined that the financial, <br />legal, and technical ability of the Grantee is reasonably <br />sufficient to provide services, facilities, and equipment necessary <br />to meet the future cable -related needs of the community, desires to <br />enter into this Franchise with Grantee for the construction and <br />operation of a cable system on the terms set forth herein. <br />SECTION 1 <br />Definition of Terms <br />1.1 Terms. For the purpose of this Franchise, the following <br />terms, phrases words and abbreviations shall have the meanings <br />ascribed to them below. When not inconsistent with the context, <br />words used in the present tense include the future tense, words in <br />the plural number include the singular number, and words in the <br />singular number include the plural number: <br />A. "Affiliate" when used in relation to any person, means another <br />person who owns or controls, is owned or controlled by, or is <br />under common ownership or control with, such person. <br />B. "Basic Cable" is the tier of service regularly provided to all <br />subscribers that includes the retransmission of local <br />broadcast television signals. <br />"Expanded Basic" (or "Plus") Service is the tier of service <br />provided as an optional level of service, which typically <br />includes satellite delivered programming. Grantee reserves <br />the right to establish other optional tiers of service. <br />C. "Cable Act" means the Cable Communications Policy Act of 1992, <br />as amended. <br />D. "Cable Service" means the one-way transmission to subscribers <br />of video programming or other programming service, and <br />subscriber interaction, if any, which is required for the <br />selection of such video programming or other programming <br />service. <br />4 <br />
