The Franchising Authority, having determined that the financial, legal, and technical ability of the Grantee is reasonably sufficient to provide services, facilities, and equipment necessary to meet the future cable -related needs of the community, desires to enter into this Franchise with Grantee for the construction and operation of a cable system on the terms set forth herein. SECTION 1 Definition of Terms 1.1 Terms. For the purpose of this Franchise, the following terms, phrases words and abbreviations shall have the meanings ascribed to them below. When not inconsistent with the context, words used in the present tense include the future tense, words in the plural number include the singular number, and words in the singular number include the plural number: A. "Affiliate" when used in relation to any person, means another person who owns or controls, is owned or controlled by, or is under common ownership or control with, such person. B. "Basic Cable" is the tier of service regularly provided to all subscribers that includes the retransmission of local broadcast television signals. "Expanded Basic" (or "Plus") Service is the tier of service provided as an optional level of service, which typically includes satellite delivered programming. Grantee reserves the right to establish other optional tiers of service. C. "Cable Act" means the Cable Communications Policy Act of 1992, as amended. D. "Cable Service" means the one-way transmission to subscribers of video programming or other programming service, and subscriber interaction, if any, which is required for the selection of such video programming or other programming service. 4
