Section 9.32.040 of the Colton Municipal Code is hereby added to read <br />as follows: <br />"Sec. 9.32.040 Violation and Enforcement. <br />(A) Violation and penalties. Each violation of the provisions of this chapter is a separate <br />offense and is a misdemeanor. <br />(1) Any juvenile convicted of a misdemeanor for violations of any section of this chapter <br />may be punished by a fine not exceeding three hundred dollars or by a requirement to <br />perform city or school -approved work projects or community service or both. If <br />required to perform a project, the total time for performance shall not exceed twenty <br />hours over a period not to exceed sixty days, during times other than a juvenile's hours <br />of school attendance or juvenile, parent or legal guardian's hours of employment. <br />(2) Any parent or legal guardian violating any provisions of this chapter shall be deemed <br />guilty of a misdemeanor and upon conviction shall be fined in an amount not to exceed <br />one -thousand dollars, or by imprisonment for a period of not more than three months <br />in the county jail or by both such fine and imprisonment. <br />(B) Enforcement. <br />A peace officer may issue a citation to any juvenile, parent or guardian found to be in <br />violation of this chapter and may detain any juvenile, until the juvenile can be placed in <br />the care and custody of a parent or legal guardian or may transport the juvenile to his <br />or her home or to the school from which the juvenile is absent. If cited, the juvenile <br />and a parent or legal guardian shall appear in court as directed by the citation." <br />SECTION 5. Chapter 9.36 of the Colton Municipal Code is hereby deleted in its <br />entirety. <br />SECTION 6. The City Clerk shall certify to the passage of this Ordinance and cause <br />same or a summary thereof to be published within fifteen (15) days after adoption in a newspaper of <br />general circulation, printed and published in Colton, California, and the Ordinance shall take effect <br />thirty (30) days after its enactment in accordance with the provisions of California law. <br />RVPUB\SRC\37472 <br />-5- <br />
