1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />e <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />ORDINANCE NO. 0-21-99 <br />AN ORDINANCE OF THE CITY OF COLTON AMENDING <br />SECTION 18.58.070(A) OF THE COLTON MUNICIPAL CODE <br />RELATING TO THE EXPIRATION OF CONDITIONAL USE <br />PERMITS AND VARIANCES <br />THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS <br />FOLLOWS: <br />SECTION 1: Section 18.58.070(A) of the Colton Municipal Code is <br />amended to read as follows: <br />"A. The decision of the commission on all variances and conditior <br />use permits shall be final following a ten (10) day appeal period. Any variance <br />conditional use permit granted by the commission shall become null and void <br />not exercised within one year of the date of approval thereof. Upon writt <br />application by the applicant or property owner filed prior to the expiration of t <br />approved variance or conditional use permit, the time at which the variance <br />conditional use permit expires shall be extended by the commission for <br />additional one year period, at a time, if the applicant or property owner provid <br />the Planning Commission with written evidence demonstrating that the varian <br />or conditional use permit is the subject of a lawsuit filed in a court of compete <br />jurisdiction. No more than four (4) extensions may be granted for any approv <br />variance or conditional use permit. Upon written application by the applicant <br />property owner filed prior to the expiration of the approved variance <br />conditional use permit, the approved variance or conditional use permit shy <br />automatically be extended for 30 days or until the application for extension <br />approved or denied, whichever occurs first. All requests for extension shall 1 <br />acted upon by the commission on the consent calendar." <br />SECTION 2: The City Clerk shall certify to the passage of this Ordinance ar <br />cause the same or a summary thereof to be published within fifteen (15) days after adoption in <br />newspaper of general circulation, printed and published in Colton, California, and the Ordinam <br />shall take effect thirty (30) days after its enactment in accordance with the provisions <br />California law. <br />ATTEST: <br />Carolina'P <br />City Clerk <br />PASSED, APPROVED, ANDADOPT D, this 19t day of October, 1999. <br />ar aytan <br />Mayor <br />
