1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 ORDINANCE NO. 0-22-01 AN ORDINANCE OF THE CITY OF COLTON AMENDING TITLE 8, CHAPTER 8.04 OF THE COLTON MUNICIPAL CODE BY ADDING SUBDIVISION (R) TO SECTION 8.04.030 TO CLASSIFY STORAGE OF COMMERCIAL AND CONSTRUCTION VEHICLES, MACHINERY AND MATERIALS IN RESIDENTIAL ZONES AND PUBLIC PLACES AS A PUBLIC NUISANCE WHEREAS, California Government Code § 38771 permits the legislative body of City of Colton (the "City") to declare what constitutes a nuisance per se; and WHEREAS, California Government Code § 38775 permits the legislative body of the City to prohibit and prevent encroachments upon or obstructions in or to any sidewalk, street alley, lane, court, park, or other public place and to provide for the removal of sucl encroachment or obstruction; and WHEREAS, California Vehicle Code § 22507 permits the legislative body of the City prohibit or restrict the stopping, parking or standing of any type of vehicle on certain streets highways, or portions thereof; and WHEREAS, the City has determined that the storage and use of certain commercia vehicles and items in residentially zoned or developed areas of the City unreasonably interfere: with the use and enjoyment of such real property. THE CITY COUNCIL OF THE CITY OF COLTON DOES ORDAIN AS FOLLOWS: SECTION 1: Subdivision (R) is hereby added to Section 8.04.030 of the C Municipal Code to read as follows: "8.04.030(R) Commercial Vehicles/ Machinery/ Materials. R. 1. Keeping, storing, or maintaining on any property in a residential zone o on any residentially developed property any of the following: a. Construction and/or business equipment, supplies, materials, o machinery of any type or description; or b. Buses, tow trucks, dump trucks, flatbed trucks, tractors, tracto trailers, truck trailers; or
