1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 0-05-02 AN ORDINANCE OF THE CITY OF COLTON AMENDING SECTIONS 7.08.100 AND 7.08.150 OF THE COLTON MUNICIPAL CODE AND ADDING CHAPTER 7.10 OF TITLE 7 OF THE COLTON MUNICIPAL CODE REGARDING VICIOUS DOGS WHEREAS, the City of Colton ("City") is authorized pursuant to Article 7, Section I I of the ICalifornia Constitution to "make and enforce within its limits all local, police, sanitary, and other Iordinances and regulations not in conflict with general laws ", including the regulation of animals; I and WHEREAS, the City is authorized pursuant to Food and Agriculture Code Sections 31621 and 31683 to adopt and administer an administrative procedure for the regulation and prohibition of potentially dangerous and vicious dogs; and WHEREAS, the City is further authorized by Government Code Section 36901 to impose I fines, penalties, and forfeitures for violations of the City's ordinances; and WHEREAS, the City Council of the City of Colton hereby finds and declares all of the I following: (a) Potentially dangerous and vicious dogs have become a serious and widespread threat Ito the safety and welfare of citizens of this City. In recent years, they have assaulted without provocation and seriously injured numerous individuals, particularly children, and have killed numerous dogs. Many of these attacks have occurred in public places. (b) The number and severity of these attacks are attributable to the failure of owners and keepers of dogs to register, confine, and properly control vicious and potentially dangerous dogs. (c) The necessity for the regulation and control of vicious and potentially dangerous dogs is a serious problem, requiring swift reaction by the City, and existing laws are inadequate to deal with the threat to public health and safety posed by vicious and potentially dangerous dogs.
