7.10.130 Prohibition of owning, possessing, controlling, or having custody. 7.10.140 Penalty; fines. 2 3 7.10.010 Definitions. (a) Animal Control Department Defined. "Animal control department" or "Department" 4 means the City of Colton Animal Control Department, or whatever entity performs any of the animal control functions for the City of Colton. 5 (b) Chief of Police. "Chief of Police" means the Chief of the Colton Police Department, or 6 designee. 7 (c) City. "City" means the City of Colton. 8 (d) County. "County" means San Bernardino County. 9 (e) Enclosure. "Enclosure" means a fence or structure suitable to prevent the entry of young lo children, which is suitable to confine a vicious dog in conjunction with other measures which may be taken by the owner or keeper of the dog. The enclosure shall be designed in order to prevent the 11 animal from escaping. The animal shall be housed pursuant to Section 597t of the Penal Code. 12 (f) Hearing Authority. "Hearing Authority" means the Code Enforcement Housing Advisory 13 Appeals Board, or such other person or entity designated by the City Manager of the City to administer hearings pursuant to this Chapter. 14 (g) Impounded. "Impounded" means taken into the custody of the animal shelter or Animal 15 Control Department. 16 (h) Potentially Dangerous Dog. "Potentially dangerous dog" means any of the following: 17 (1) Any dog that, when unprovoked, on two separate occasions within the prior 36 -month period, engages in any behavior that requires a defensive action by any person to prevent bodily injury when 18 the person and the dog are off the property of the owner or keeper of the dog. (2) Any dog that, when unprovoked, bites a person causing less than severe injury. 19 (3) Any dog that, when unprovoked, on two separate occasions within the prior 36 -month period, has seriously bitten, inflicted injury, or otherwise caused injury attacking a domestic animal off the 20 property of the owner or keeper of the dog. (4) Any dog that in a threatening or annoying manner barks, snarls or menaces a person or 21 persons within the City. 22 (i) Severe Injury. "Severe injury" means any physical injury that results in muscle tears or 23 disfiguring lacerations or requires multiple sutures or corrective or cosmetic surgery. 24 0) Vicious Dog. "Vicious dog" means any of the following: (1) Any dog seized under Section 599aa of the Penal Code and upon the sustaining of a 25 conviction of the owner or keeper under subdivision (a) of Section 597.5 of the Penal Code. (2) Any dog that, when unprovoked, in an aggressive manner, inflicts severe injury on or kills a 26 human being or domestic animal. 27 (3) Any dog previously determined to be and currently listed as a potentially dangerous dog that, after its owner or keeper has been notified of this determination, continues the behavior described in 28 Section 7.10.010, subdivision (h) or is maintained in violation of Sections 7.10.080, 7.10.090, or 7.10.100. 7.10.020 Nonapplication of Chapter.
