1 It shall be unlawful for any person owning or having control or custody of any dog: <br />(a) To permit or allow the dog to defecate upon public property, including, but not limited to, any <br />2 sidewalk, street, park, public right-of-way, or other public area, within the City unless the owner or the <br />person having control or custody of the dog immediately removes the feces and property disposes the <br />3 container of the feces in a sanitary manner; or <br />(b) To permit or allow the dog to defecate upon private property neither owned nor occupied by said <br />4 person unless the owner or the person having control or custody of the dog immediately removes the <br />feces and property disposes the container of the feces in a sanitary manner; or <br />5 (c) To walk a dog on public or private property without carrying at all times a suitable containeror other <br />suitable instrument for the removal and disposal of canine feces. <br />6 <br />12.40.20 Method of Disposal. <br />7 <br />8 Any person owning or having control or custody of a dog will have on or near their person a tool or <br />device, such as a plastic bag, or any other disposable vessel that can be used to fully clean-up and <br />9 contain the feces, unexposed to said person or the public, until it can be disposed of in a trash can or <br />other appropriate recepticle. Such a device must be produced and shown to anyone authorized to <br />10 enforce this chapter upon request. <br />11 12.40.30 Enforcement. <br />12 Violation of this chapter shall be punishable as follows: <br />First Offense (over a 12 -month period) $ 50.00 <br />13 Second Offense (over a 12 -month period) $100.00 <br />Third Offense and each subsequent offense (over a 12 -month period) $150.00 <br />14 <br />12.40.40 Exemption. <br />15 <br />This chapter shall not apply to a dog accompanying any handicapped person who, by reason of his <br />16 or her handicap, is physically unable to comply with the requirements of this chapter or to any <br />17 individual who utilizes a guide dog. <br />18 SECTION 2. If any provision of this Ordinance or the application thereof to any person <br />or circumstance is held invalid, that invalidity shall not affect other provisions or applications of <br />19 the chapter which can be given effect without the invalid provision or application, and to this <br />end the provisions of this Ordinance are severable. <br />20 <br />SECTION 3: The City Clerk shall certify to the passage of this Ordinance and cause the <br />21 same or a summary thereof to be published within fifteen (15) days after adoption in a newspaper of <br />general circulation, printed and published in Colton, California, and the Ordinance shall take effect <br />22 thirty (30) days after its enactment in accordance with the provisions of California law. <br />23 PASSED, APPROVED, AND ADOPTED, this 16 day of July, 2002. <br />24 �)o I L__�L \-8"/n 22_1�� <br />25 DEIRDRE H.
