1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15' <br />16'' <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />ORDINANCE NO. 0-19-02 <br />AN ORDINANCE OF THE CITY OF COLTON, CALIFORNIA ADDING <br />SECTION 18.48.110 TO TITLE 18, CHAPTER 18.48 OF THE COLTON <br />MUNICIPAL CODE RELATING TO TEMPORARY OUTDOOR DISPLAYS <br />AND SALES <br />WHEREAS, the City Council of the City of Colton wishes to allow temporary <br />outdoor displays and sales in order to promote business within the City; and <br />WHEREAS, such temporary outdoor displays and sales have a tendency of <br />exposing neighboring residents to crowds, excessive congestion and traffic; and <br />WHEREAS, the City Council wishes to ensure that such temporary outdoor <br />displays and sales are conducted in a safe and orderly fashion by requiring that such events <br />follow uniform licensing procedures; and <br />WHEREAS, uniform procedures promote and protect the rights of those <br />organizing temporary outdoor displays and sales, those participating in them, and those <br />living and working nearby. <br />THE CITY COUNCIL OF THE CITY OF COLTON ORDAINS AS FOLLOWS: <br />Section 1: Section 18.48.110 is hereby added to Title 18, Chapter 18.48 of the <br />Calton Municipal Code to read as follows: <br />18.48.110. Temporary Outdoor Displays and Sales. <br />(A) No person, business or organization shall conduct, operate, maintain, <br />organize, or advertise a temporary outdoor display or sale without first obtaining a Temporary <br />Outdoor Displays and Sales Permit as provided by this Section. Temporary Outdoor <br />Displays and Sales Permit applications shall be reviewed by the City Manager or his or her <br />designee and issued prior to the commencement of the temporary outdoor display or sale. <br />(B) Applications for a Temporary Outdoor Display and Sales Permit shall <br />be made on forms prescribed by the City and shall include a site plan indicating the proposed <br />location of the display area. Such applications shall be filed not less ten (10) working days <br />prior to the outdoor temporary display or sale and shall be filed with the City Manager or his <br />or her designee. <br />(C) The City Manager shall issue the permit, conditioned upon the <br />applicant's written agreement to comply with any and all terms of this Section, including but <br />not limited to the following conditions: <br />(1) Outdoor sales shall only be permitted as an extension of an <br />
