1 2 ORDINANCE NO. 0-18-03 3 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF 5 COLTON AMENDING THE SANTA ANA RIVER REDEVELOPMENT PROJECT SPECIFIC PLAN AND APPROVING A MITIGATED 6 NEGATIVE DECLARATION AND MITIGATION MONITORING AND 7 REPORTING PROGRAM: FILE INDEX NO. D-38-00 8 WHEREAS, an application was filed byTaormina Industries to amend portions of the 9 Santa Ana River Redevelopment Project Area Specific Plan ("Specific Plan") to specify/clarify that io "materials recovery and transfer facilities" are among the conditionally -permitted la'nd uses within the 11 Specific Plan area and make other minor changes to Section 4.7 of the Specific Plan ("Application"); and 12 13 WHEREAS, the Application was referred to all affected public agencies for review 14 and consideration; and 15 WHEREAS, the Application was reviewed, studied, and found to be consistent with 16 the City's adopted General Plan and the Specific Plan; and 17 WHEREAS, on July 8, 2003, the Planning Commission of the City of Colton 18 ("Planning Commission") conducted a duly noticed public hearing on the Application at which time 19 all persons wishing to testify in connection with the proposed Application were heard, and the 20 Application was comprehensively reviewed; and 21 WHEREAS, the Planning Commission also considered the information contained in 22 the draft mitigated negative declaration and mitigation monitoring and reporting program prepared 23 for the Application in compliance with the California Environmental Quality Act (CEQA) and the CEQA Guidelines, including the initial study and comments received during the public review period; 24 and 25 26 WHEREAS, at the conclusion of the public hearing the Planning Commission, by a vote of 3 in favor and 2 against voted to recommend the Application to the City Council; However 27 because specific plan amendments require a minimum of 4 votes for passage, the Application was 28 not recommended for approval by the Planning Commission; and
