1 <br />2 ORDINANCE NO. 0-18-03 <br />3 <br />4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />5 COLTON AMENDING THE SANTA ANA RIVER REDEVELOPMENT <br />PROJECT SPECIFIC PLAN AND APPROVING A MITIGATED <br />6 NEGATIVE DECLARATION AND MITIGATION MONITORING AND <br />7 REPORTING PROGRAM: FILE INDEX NO. D-38-00 <br />8 <br />WHEREAS, an application was filed byTaormina Industries to amend portions of the <br />9 Santa Ana River Redevelopment Project Area Specific Plan ("Specific Plan") to specify/clarify that <br />io "materials recovery and transfer facilities" are among the conditionally -permitted la'nd uses within the <br />11 Specific Plan area and make other minor changes to Section 4.7 of the Specific Plan ("Application"); <br />and <br />12 <br />13 WHEREAS, the Application was referred to all affected public agencies for review <br />14 and consideration; and <br />15 WHEREAS, the Application was reviewed, studied, and found to be consistent with <br />16 the City's adopted General Plan and the Specific Plan; and <br />17 <br />WHEREAS, on July 8, 2003, the Planning Commission of the City of Colton <br />18 ("Planning Commission") conducted a duly noticed public hearing on the Application at which time <br />19 all persons wishing to testify in connection with the proposed Application were heard, and the <br />20 Application was comprehensively reviewed; and <br />21 WHEREAS, the Planning Commission also considered the information contained in <br />22 the draft mitigated negative declaration and mitigation monitoring and reporting program prepared <br />23 for the Application in compliance with the California Environmental Quality Act (CEQA) and the <br />CEQA Guidelines, including the initial study and comments received during the public review period; <br />24 and <br />25 <br />26 WHEREAS, at the conclusion of the public hearing the Planning Commission, by a <br />vote of 3 in favor and 2 against voted to recommend the Application to the City Council; However <br />27 because specific plan amendments require a minimum of 4 votes for passage, the Application was <br />28 not recommended for approval by the Planning Commission; and <br />
