RESOLUTION NO. R-93-88 <br />A RESOLUTION OF THE CITY OF COLTON <br />FINDING AND DETERMINING THAT THE PUBLIC <br />INTEREST, CONVENIENCE, AND NECESSITY <br />REQUIRE THE ACQUISITION OF CERTAIN REAL <br />PROPERTY; <br />WHEREAS, a recent study conducted in the City has <br />revealed a serious shortage of park land for recreation use <br />and enjoyment; and <br />WHEREAS, recently approved development in and around the <br />areas of the intersection of San Bernardino and Eucalyptus <br />Avenues will result in a higher concentration of residents in <br />that area, and a corresponding higher demand for the use and <br />availability of recreational facilities, including parks; and <br />WHEREAS, the area at the intersection of San Bernardino <br />and Eucalyptus Avenues is centrally located, such that a park <br />in that location will serve a large segment of the residents <br />the City; and <br />WHEREAS, this location may also serve as an interim site <br />for a detention basin until such time as permanent drainage <br />facilities may be fully developed; and <br />WHEREAS, the City Council has determined that it is in <br />the best interests of the public health, safety, and welfare <br />to establish a park at this location; and <br />WHEREAS, the City is authorized to exercise the powers <br />of eminent domain for such purposes under California <br />Constitution Article I, Section 19, and Government Code <br />Section 40404, among other sections; <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON <br />DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: <br />1. That on September 20, 1988, after written notice <br />mailed on September 2, 1988 to the owners of the property <br />described in Exhibit "A", as they appeared on the last <br />equalized County Assessment Roll, the City Council held a <br />hearing for allowing the owners thereof a reasonable <br />opportunity to appear and be heard on the following matters: <br />(a) Whether the public interest or necessity <br />requires the project; <br />(b) Whether the project is planned or located in a <br />manner which is most compatible with the <br />greatest public good and the least private <br />
