RESOLUTION NO. R-96-88 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON DETERMINING THE CONFORMITY OF THE <br />CITY'S VALLEY AND EUCALYPTUS STORM DRAIN PLAN <br />WITH THE DRAINAGE GENERAL PLAN FOR THE COUNTY <br />OF SAN BERNARDINO <br />WHEREAS, Government Code Section 66483 authorizes the <br />City of Colton (the "City") to impose fees by local ordinance for <br />the purpose of defraying the actual or estimated costs of <br />constructing planned drainage facilities for the removal of <br />surface and storm waters from local drainage areas; and <br />WHEREAS, as a condition of imposing such fees, any city <br />situated in a county having a county -wide general drainage plan <br />must, by resolution, determine that the city's drainage plan is in <br />conformity with the drainage general plan of the county; and <br />WHEREAS, it is the desire of this City Council to levy <br />fees on new development to reimburse the City's Community <br />Facilities District No. 87-1 for its construction of planned <br />drainage facilities which benefit new development outside <br />Community Facilities District No. 87-1 (the City's "Valley and <br />Eucalyptus Storm Drain Plan"); and <br />WHEREAS, the City's Planning Commission determined <br />that the City's Valley and Eucalyptus Storm Drain Plan <br />is in conformity with the County of San Bernardino's Drainage <br />General Plan; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF COLTON that the storm drain facilities improvements <br />constructed within Community Facilities District No. 87-1, and the <br />
