R-150-89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON ESTABLISHING STORM DRAIN FACILITIES FEES FOR DRAINAGE BENEFIT AREA NO. 1 WHEREAS, the City Council of the City of Colton ("this City Council") has adopted Ordinance No. 0-27-88 to establish the requirement for the payment of storm drain fees by new subdivision development within Drainage Benefit Area No. 1 to ensure that storm drain facilities and improvements are constructed and made available concurrent with the need caused by such new development; and WHEREAS, Ordinance No. 0-27-88 requires that this City Council shall, by resolution, set the specific amount of fees which will be levied upon new subdivision development within Drainage Benefit Area No. 1; and WHEREAS, the San Bernardino County Flood Control District has undertaken a comprehensive study of the storm drain facilities needed to serve new subdivision development proposed within Drainage Benefit Area No. 1; and WHEREAS, the results of this study demonstates that the storm drain facilities fees should be based upon the gross number of acres proposed within each new subdivision development and the estimated runoff calculation resulting from the construction of such development. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLTON AS FOLLCWINGS: Section 1. Fee Amount. Storm drain facilities fees for new subdivision development proposed with Drainage Benefit Area No. 1 shall be $14,740 per gross acre of such development. Section 2. Exemptions.
