R-150-89 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />ESTABLISHING STORM DRAIN FACILITIES FEES FOR DRAINAGE <br />BENEFIT AREA NO. 1 <br />WHEREAS, the City Council of the City of Colton ("this City <br />Council") has adopted Ordinance No. 0-27-88 to establish the requirement for <br />the payment of storm drain fees by new subdivision development within <br />Drainage Benefit Area No. 1 to ensure that storm drain facilities and <br />improvements are constructed and made available concurrent with the need <br />caused by such new development; and <br />WHEREAS, Ordinance No. 0-27-88 requires that this City Council <br />shall, by resolution, set the specific amount of fees which will be levied <br />upon new subdivision development within Drainage Benefit Area No. 1; and <br />WHEREAS, the San Bernardino County Flood Control District has <br />undertaken a comprehensive study of the storm drain facilities needed to <br />serve new subdivision development proposed within Drainage Benefit Area No. <br />1; and <br />WHEREAS, the results of this study demonstates that the storm <br />drain facilities fees should be based upon the gross number of acres <br />proposed within each new subdivision development and the estimated runoff <br />calculation resulting from the construction of such development. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />COLTON AS FOLLCWINGS: <br />Section 1. Fee Amount. Storm drain facilities fees for new <br />subdivision development proposed with Drainage Benefit Area No. 1 shall be <br />$14,740 per gross acre of such development. <br />Section 2. Exemptions. Any new subdivision development which is <br />within, or becomes a part of, a community facilities district in which <br />
