1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />RESOLUTION NUMBER R-36-89 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON DETERMINING THE AMOUNT OF PROPERTY TAX <br />REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE <br />COUNTY OF SAN BERNARDINO AND THE CITY OF COLTON <br />RESULTING FROM THE JURISDICTIONAL CHANGES <br />DESCRIBED BY LOCAL AGENCY FORMATION COMMISSION <br />NUMBER 2513 AND REPEALING RESOLUTION NUMBER <br />R-2-89 <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLTON AS <br />FOLLOWS: <br />SECTION 1 <br />The Citv Council of the City of Colton hereby finds and determines <br />that: <br />A. Pursuant to Section 99 of the Revenue and Taxation Code, <br />prior to the issuance of a certificate of filing by the <br />Local agency Formation Commission Executive Officer, the <br />governing bodies of all local agencies whose service area <br />or service responsibilities will be altered by a proposed <br />jurisdictional change shall negotiate and determine by <br />resolution the amount of property tax revenues to be <br />exchanged between and among such local agencies. <br />B. Except as provided in Section 99.1 of the Revenue and <br />Taxation Code, in the event that a jurisdictional change <br />would affect the service area or service responsibility <br />of one or more special district, the Board of Supervisors <br />of the County of San Bernardino shall, on behalf of the <br />district or districts, negotiate any exchange of property <br />tax revenues. <br />
