AGUILERA, Director <br />V 3-89 <br />PLASTI LINE, FOR <br />BURGER KING <br />MAJOR VARIANCE TO ALLOW A 65 <br />FOOT HIGH SIGN IN AN AREA <br />WHERE 45 FEET IS THE MAXIMUM <br />HEIGHT ALLOWED <br />The applicant purchased the property on the southeast corner of 9th <br />Street and Valley Boulevard with the intention of utilizing the existing <br />pole sign for the purpose of placing the Burger King sign on the pole <br />previously used for the Texaco gas station. <br />The pole sign (with twin poled currently has a height of 55 feet to the <br />top of the poles, with a 10 foot high sign "can" the top of the sign <br />will be 65 feet or 20 feet higher than the allowed height by ordinance. <br />ANALYSIS <br />The Design Review Committee reviewed the proposal on February 6, 1989) <br />and made the following findings: <br />1. The proposed business is a business which relies, to some extent, <br />on freeway traffic. <br />2. Other similar businesses under similar circumstances have been <br />granted variances, i.e., Taco Bell, Great Gatsby Pizza, the Bluffs <br />Restaurant. <br />3. The Zoning Ordinance allows variances if it can be shown that the <br />ordinance as written would deprive the applicant of rights enjoyed <br />by other property under similar circumstances, because the property <br />has some unique circumstances regarding location, topography, etc. <br />4. The Design Review Committee found that due to location the property <br />is eligible for a "freeway oriented sign." <br />5. The Design Review Committee further found that due to topography <br />(freeway height) a 45 foot high sign could not be visible from the <br />freeway and, therefore, only a 65 foot high sign could afford the <br />applicant visibility allowed by the Zoning Ordinance. <br />
