R-130-90 <br />A RESOLUTION OF THE CITY OF CDL70N CITY COUNCIL <br />APPROVING FILE INDEX NO. OC -54-90 AN APPEAL OF A <br />PLANNING COMMISSION DECISION TO DENY A LIQUOR SALES <br />CONDITIONAL USE PERMIT <br />WHEREAS the Maclin Markets did appeal a Flannina Commission <br />decision to deny File No. D-54-90; and <br />WHEREAS the Citv of Colton did properiv advertise and post a <br />public hearing to consider an appeal by the Maclin Markets; and <br />WHEREAS the Council having heard all pertinent testimony; <br />and <br />WHEREAS the Council made the following findings: <br />A) The Maclin Markets have been operating under a beer <br />and wine license for several years and a liquor <br />license for several months and the operator has not <br />caused or been the cause of any known or reported <br />incidents related to alcohol consumption. <br />B) The provision of alcoholic beverages is a service <br />which is compatible with the type of atmosphere <br />provided by the auction. <br />C) The auction provides shopping and recreational <br />activities for the benefit of the entire community. <br />NOW THEREFORE, BE ,IT RESOLVED that the city Council o+ the <br />City of Colton does hereby approve file No. D-54-90. <br />PASSED, APPROVED, and ADOPTED this 20th, day day of November <br />1990. _.._ . <br />FRA�A- <br />NIAS ayor <br />ATTEST: <br />HELEN A.
