ANNEXATION NO. 44 WHEREAS, the City Council of the City of Colton, California, has previously formed a special maintenance district pursuant to the terms of the "Landscaping and Lighting Act of 1972"(the "Act"), being Division 15, Part 2 of the Streets and Highways Code of the State of California., said special maintenance district known and designated as MAINTENANCE DISTRICT NUMBER 1 (hereinafter referred to as the "Maintenance District")'; and, WHEREAS, the provisions of Article II of Chapter 2 of the Act authorizes the legislative body to order the annexation of territorV to the Maintenance District; and, WHEREAS, the legislative body may, pursuant to said provisions of the Act, order the annexation of territory to the Maintenance District without notice and hearing, or filing of an Engineer's "Report" as would otherwise be required bV the, provisions of the Act if all of the owners of propertV within the territory proposed to be annexed have given written consent to �tie proposed annexation; and, WHEREAS, the undersigned, the owners of all property within the territory proposed to be annexed to the "Maintenance District" acknowledge that pursuant to the provisions of the Act, the undersigned would be entitled to notice and hearing and the preparation of an Engineer's "Report" pertaining pito' the annexation of the property, acknowledae that they are aware of the i �-proposed annexation to the Maintenance District of the property owned by the undersigned, and waives any and all rights which the undersigned may now have to not -ice and hearing or filing of an Engineer's "Report" - p6rtaininq to the annexation of the undersigns property to the Maintenance District. qVQW, THEREFORE, it is hereby declared by the undersigned property owners as follows; 1. That the above recitals are all true and correct. S.
