R-26-91 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON PERTAINING TO TENTATIVE TRACT 12201 <br />AND A SETTLEMENT AGREEMENT TO APPROVE 52 SINGLE <br />FAMILY ATTACHED RESIDENTIAL UNITS <br />WHEREAS, circa 1982 the City Council did review Tentative <br />Tract 12201, and; <br />WHEREAS, the Kencor Corporation may have acted in good faith <br />reliance on possible representations made by the City of Colton, <br />and; <br />WHEREAS, the City of Colton and Kencor have amicably <br />resolved all matters which could lead to litigation, and; <br />WHEREAS, the City Council of the City of Colton does find <br />that the Kencor proposal will be an asset to the community and is <br />in keeping with good planning standards and ordinances; <br />NOW, THEREFORE, BE IT RESOLVED, the City Council of the <br />City of Colton does hereby approve Tentative Tract 12202 to <br />include the following: <br />1) 52 single family attached units per the site plan <br />submitted; <br />2) The City Council will support Kencor's request of the <br />Colton Unified School District to allow for credit of <br />fees to another Kencor tract located on Placid Lane; <br />3) Tentative Tract 12201 is subject to all conditions of <br />approval previously set through file numbers TT 12201 <br />and D-65-90; <br />4) Kencor agrees to cease the pursuit of litigation <br />regarding the allowable development of Tentative Tract <br />12201. <br />
