It is the intention of the Parties hereto to settle and dispose of, fully and completely, <br />any and all claims for relief, causes of action and demands heretofore or hereafter arising out of, <br />connected with, or incidental to, or by reason of the Action. <br />AGREEMENT <br />The Parties covenant and agree that: <br />1. This Agreement is binding upon and shall inure to the benefit of all Parties hereto, <br />and to their respective past and present officers, directors, council members, agents, employees, <br />representatives, employers, insurers, attorneys, accountants, advisers, partners, partnerships, <br />divisions, subsidiaries, affiliates, assigns, heirs, successors and predecessors in interest, <br />shareholders, joint venturers, commonly controlled corporations, ventures, projects, trusts and other <br />entities. <br />2. Within ten (10) business days after receipt of counterparts of this Agreement, <br />executed by all Parties, Plaintiff shall cause to be filed in the Superior Court an executed Request <br />for Dismissal with Prejudice of the action described in paragraph 2 of the Recitals section of this <br />Agreement as to the Defendants. Plaintiff shall also cause to be filed in said court an executed <br />Request for Dismissal Without Prejudice as to Logan P. Green, George Kokonis and Dean Kokonis. <br />3. Each Party shall bear its or his own attorneys' fees and costs which have been <br />incurred in the prosecution or defense of the Action, as the case may be, including costs incurred <br />on any appeal from the judgment or any post judgment order in the Action. <br />4. The Parties hereby mutually release each other, and those persons identified in <br />paragraph I above from all claims, demands, causes of action and actions, which any party may <br />
