SEPARATION AGREEMENT <br />The parties to this agreement are Edmund F. Sotelo <br />("Sotelo") and the City of Colton ("Colton"). Heretofore, Sotelo <br />has been City Manager of Colton. Heretofore, these parties entered <br />into an employment agreement which provided for Sotelo's employment <br />as City Manager of Colton for a term ending May 14, 1992 and which <br />also provided for earlier termination and, in limited circum- <br />stances, for severance pay. Sotelo makes claims against Colton and <br />its officials which they dispute and deny. Colton and its <br />officials make claims against Sotelo which he disputes and denies. <br />The execution of this agreement is not an admission of wrongdoing <br />by anyone. The purpose of this agreement is to avoid litigation <br />and to make it unnecessary to assert or defend claims between the <br />parties. <br />The parties agree as follows: <br />1. Sotelo is no longer City Manager of Colton. His <br />employment, as such, has ended. Colton shall pay Sotelo through <br />June 30, 1991the salary of city manager at the rate of Seven Thousand <br />One Hundred Thirty-eight Dollars ($7,138.00) per month, payable <br />biweekly, together with the following benefits: health, dental, <br />optical, life, and disability insurance and PERS seven percent (7-%) <br />employee contribution. Such benefits shall not be greater than <br />provided to other Colton employees. <br />32 <br />
