cost or expense as may have been sustained, may give rise to <br />additional damages, loss, cost or expense in the future. <br />Nevertheless, COLTON acknowledges that this Agreement and <br />Release has been negotiated and agreed upon in light of that <br />situation, and hereby expressly waives any and all rights <br />which it may have under California Civil Code Section 1542 <br />or under any other state or federal statutes or common law <br />principle of similar effect. <br />6. GRAND TERRACE hereby releases and forever <br />discharges COLTON, its predecessors, successors, assigns, <br />officers, councilmembers, and each past and present <br />employee, agent, representative, attorney, witness and any <br />other person, firm or corporation now, previously or here- <br />after affiliated in any manner with any of the above, from <br />any and all claims, demands, causes of action, obligations, <br />damages and liabilities, whether or not now known, suspected <br />or claimed, which GRAND TERRACE may have against COLTON, by <br />reason of any act, failure to act, cause, matter or event <br />whatsoever, including but not limited to any related to the <br />existence of the subject matters encompassed within, and all <br />claims which were raised in or could have been raised in <br />Case No. 229708 or by reason of the existence of that <br />action. <br />7. GRAND TERRACE acknowledges that it has been <br />advised by its attorneys concerning, and is familiar with, <br />the provisions of the California Civil Code Section 1542, <br />which provides as follows: <br />-5- <br />
