R-93-91 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON SUPPORTING A MEASURE TO REPEAL THE <br />BOOKING FEES AUTHORIZED BY SB 2557 <br />BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL AS <br />FOLLOWS: <br />WHEREAS, the State Legislature adopted SB 2557 which <br />authorized counties to enhance their revenue base by charging <br />cities to book prisoners as well as to administer the collection <br />of property taxes; and, <br />WHEREAS, SB 2557 also authorized counties to enhance <br />their revenue base by imposing a utility tax and business <br />license fees in unincorporated -areas; and, <br />WHEREAS, the Board of Supervisors, in lieu of imposing <br />a utility users tax or business license fee, elected to adopt <br />Ordinance No. 3428 on January 4, 1991, authorizing the collec- <br />tion of booking fees retroactive to July 1, 1990; and, <br />WHEREAS, the Board of Supervisors' failure to seriously <br />consider the imposition of a utility users tax or business <br />license fee in unincorporated areas as an alternate to booking <br />fees imposes a financial hardship on every city in the County; <br />and, <br />WHEREAS, the failure of the Board of Supervisors to <br />address the financial hardships imposed on cities by the im- <br />position of booking fees has forced cities to cut back essential <br />city services; and, <br />WHEREAS, litigation is being pursued by San Bernardino <br />County cities to challenge the methodology used in establishing <br />the booking fee rate; and, <br />WHEREAS, prolonged litigation will only worsen the <br />financial plight of San Bernardino County; and, <br />WHEREAS, certain cities as an alternative to paying <br />booking fees are not jailing individuals arrested for minor <br />offenses. <br />NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City <br />Council of the City of Colton do hereby support a ballot measure <br />to repeal the booking fees authorized by SB 2557. <br />
